Please read this document carefully. This is a legal agreement between you (either an individual or an entity) and SurfStats Software CC. (SurfStats), the developer of SurfStats Log File Analyzer. This Agreement supersedes any prior version license and governs your use of the SOFTWARE.

The retail version will work for 30 days but requires that you register your licensed copy at SurfStats at no additional fee. On registration and on receipt of the machine identification number from you, SurfStats will send you an unlock (activation) code by e-mail that will remove the time period limitation. The licensed product will only work on the machine on which it was licensed.

The trial download version is fully functional for 30 days and is provided to evaluate the application’s functionality, capabilities and suitability to task. If you continue to use it after the 30-day trial period, you MUST register it or remove it from your computer.

The activated or unlocked software DOES NOT expire.

INDEMNIFICATION. By installing and using the SurfStats software ("SOFTWARE") on your computer, you agree to save and hold harmless SurfStats from any loss, direct or consequential damage, or claim incurred by you resulting from reliance upon the results obtained through the use of the SOFTWARE. If you disagree with any of these terms, do not install this software or remove the SOFTWARE together with all copies of it from your computer.

GRANT OF LICENSE. This license gives you certain limited rights to use the Software. You do not become an owner of and SurfStats retains title to all the Software, Software Copies and Related Materials. SurfStats grants you the right to use this SOFTWARE to download log files from web site/s and analyze it as follows:

1. You may not lend, give, rent, lease, sub-license and transfer the licensed SOFTWARE and related materials to other parties without the written permission of SurfStats.

2. You may not alter, disassemble, de-compile, reverse engineer, duplicate or create a derivative work with the same "look and feel" or otherwise use the SOFTWARE except as stated in this License agreement.

3. This SOFTWARE must only be used under the conditions and on operating systems for which the SOFTWARE was designed.

4. You need a license for every machine that the program is installed on.

5. Standard Edition. You may only use the Standard Edition of SurfStats Log Analyzer to generate reports, on a single computer, for the company that purchased the license and third parties. The Standard Edition is limited to analyze up to 10 sites per machine at a time.

6. Professional Edition. SurfStats Log Analyzer Professional Edition may be used to generate reports, on a single computer, for the company that purchased the license and third parties. Although a single user license of the Professional Edition entitles you to report on unlimited sites on a machine (computer) per license, we recommend that you do not analyze more than 500 sites at a time.

7. Enterprise Edition. SurfStats Log Analyzer Enterprise Edition may be used to generate reports, on a single computer, for the company that purchased the license and third parties as well as perform proxy analysis and streaming media analysis. Although a single user license of the Enterprise Edition entitles you to report on an unlimited number of sites on a machine (computer) per license, we recommend that you do not analyze more 500 sites at a time.

8. The licenses of users are automatically revoked without the option of a refund if they do not adhere to the License Agreement and may also be prosecuted.

COPYRIGHT. The SOFTWARE and Trademark are owned by SurfStats Software CC. and is protected by International copyright laws and treaty provisions.

SOFTWARE SUPPORT. SUPPORT WILL ONLY BE PROVIDED BY E-MAIL AND ONLY ON THE MOST CURRENT VERSION. Queries regarding the installation and use of the SOFTWARE, as well as requests for additional features and enhancements, should be submitted by e-mail to support@surfstats.com. SurfStats will attempt to implement all reasonable requests but is not obliged to do so. SurfStats provides free updates and free email support for one year after purchase to licensed users. Thereafter you can purchase another year of free updates and email support. Please note that we cannot guarantee software updates.

LIMITED WARRANTY/LIMITATION OF LIABILITY. This SOFTWARE is licensed AS IS and it is your responsibility to ensure that the product works on you particular system configuration. We cannot guarantee that the program works with other third party software. These warranties are in lieu of any other warranties, expressed or implied, including the implied warranties of merchantability and fitness for a particular purpose. In no event will SurfStats be liable to you for damages, including any loss of profits, lost savings, or other incidental or consequential damages arising out of your use of or inability to use the SOFTWARE, even if SurfStats has been advised of the possibility of such damages. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE MINUS ADMINISTRATION FEES WITHIN 30 DAYS AFTER PURCHASE. The ADMINISTRATION FEES are 15 percent of the purchase price.

RESERVATION. SurfStats reserves the right to change the license agreement of the software. SurfStats reserves the right to change the product as it sees fit, including but not limited to removal, adding or changing features in new editions. SurfStats reserves the right to change prices without notice.
